A Tokyo court ruled on Sept. 25 that a law banning people under 18 from campaigning for political candidates is unconstitutional. The court said the law goes against the Constitution, which protects freedom of expression.
The law was introduced in 1952. It says that people under 18 cannot campaign for candidates and can be punished if they do. Four plaintiffs, who were 16 to 18 when they filed the case, said the law stopped them from supporting candidates during elections. They said it also made it harder for young people to take part in politics.
The court agreed that the ban was unconstitutional. However, it did not order the Japanese government to pay damages to the four people.
One plaintiff, Yoshino Miyata, 20, said she was happy with the court’s decision.
東京地裁は9月25日、18歳未満の人が政治家候補者の選挙運動をすることを禁止する法律は、違憲であるとの判決を下した。裁判所は、この法律が表現の自由を保障する憲法に反すると述べた。 この法律は1952年に導入された。18歳未満の人は候補者の選挙運動をすることができず、行なった場合は罰せられる可能性があると定めている。訴えを起こしたときに16~18歳だった4人の原告は、この法律によって、選挙中に候補者を支持することができなかったと訴えた。また、若者が政治に参加することも難しくなったと主張した。 裁判所は、この禁止は違憲であることを認めた。しかし、日本政府に4人への損害賠償を命じることはしなかった。 原告の一人である宮田香乃さん(20)は、裁判所の決定をうれしく思うと話した。

本文のit did not order the Japanese government to pay damages to the four peopleは「それ(=裁判所)は、日本政府にその4人の人々(=原告)への損害賠償の支払いを命じなかった」ということ。damageは「ダメージ、損害」という意味では数えられない名詞として使われるが、本文のように「損害賠償金」の意味ではdamagesと複数形で使われる。pay damages(損害賠償を支払う)の他、seek damages(損害賠償を求める)というパターンも押さえておこう。
